Decision Instruments

The Regulator makes many decisions in the course of its regulatory business.  We will record the most important of these decisions, as they are made, from 1 April 2012 onwards.  The decisions recorded below were all made by our predecessor as regulator.  Decision instruments five to seven remain current. 

Decision Instrument 7: The revised regulatory framework for social housing in England

This decision records the Social Housing Regulator's decision to issue the new framework.  This decision instrument remains current after 1 April 2012.


Decision Instrument 6: Guidance on the use of powers under the Housing and Regeneration Act 2008

This decision instrument set out statutory guidance on how the TSA used and intended to use its enforcement powers. This decision instrument remains current after 1 April 2012.


Decision Instrument 5: Revision to the Tenancy Standard: Affordable Rent

The purpose of this decision was, following the conclusion of statutory consultation, to issue the revised Tenancy standard which enables Private Registered Providers of social housing to participate in the 2011-15 Affordable Homes Programme to deliver homes on Affordable Rent terms.  This decision instrument remains current after 1 April 2012.


Decision Instrument 4: Guidance to co-ownership societies

The purpose of this decision was to: Give guidance to co-ownership societies; withdraw most of previous guidance; and set out decisions about how Co-ownership societies should go about setting rents and calculating premium payments. The TSA did not thereafter set rents or calculate premium paymentsm, which were to be decisions made by Co-ownership societies in accordance with the approach set out in this Decision Instrument; nor issue advisory new tenancy agreements and corresponding advisory amendments sheets for existing tenancies for use by Co-ownership Societies.


Decision Instrument 3: Guidance to co-ownership societies

The purpose of this decision was to give guidance to Co-ownership societies. In this way, the TSA was reissuing guidance previously given by the Housing Corporation about the operation of Co-ownership societies. Note: most of this Decision Instrument is replaced by Decision Instrument 4, below.


Decision Instrument 2: Consents to disposals of social housing dwellings

The purpose of this decision was to give general consent to certain disposals of social housing dwellings and grant-aided land by private registered providers and unregistered housing associations; and to give a direction regarding certain disposals of land other than social housing dwellings.


Decision Instrument 1: The Regulatory Framework

The purpose of this decision was to issue the framework under which the TSA carried out it's duties.

This has now been replaced by the The Regulatory Framework covered by Decision Instrument 7.
